Classification of Employees vs. Independent Contractors, and Impact on Relief Veterinarians

This session will address the proper classification of independent contractors and the myriad of legal tests facing employers in using independent contractors. Included in this session will be review of relief veterinarians and whether they can be classified as independent contractors.

The Use and Limitations of Non-Competes, Non-Solicitations, and Non-Disclosures

This session will address the current state of the law with respect to restrictive covenants in Wisconsin. Additionally, this session will address the benefits and drawbacks of using non-competes, non-solicitations, and non-disclosures. Lastly, the session will cover best practices for implementing restrictive covenant agreements.

Wage and Hour Requirements and Issues Facing Veterinary Clinics 

Making a determination of whether an employee is exempt or non-exempt under federal and state law can be challenging, and requires a thorough understanding of the types of exemptions under which your employees could be classified. Additionally, this session will review the somewhat common, but incorrect, view that paying commissions to an employee makes them an exempt employee. The salary basis and duties basis tests will be set forth and discussed in a practical manner.

What To Expect When OSHA Shows Up

This session will discuss an employer’s rights when OSHA knocks on your door, including how to handle the opening conference, facility inspection, and closing conference portions of the OSHA visit. Additionally, this presentation will address the citation and litigation process involving OSHA claims.

The Do's and Don'ts of Background Checks

This session will reinforce the importance of due diligence in hiring practices.
